Abstract
Asım Cüneyd Köksal'ın Fıkıh ve Siyaset Osmanlılarda Siyâset-i Şer'iyye adlı eseri, Osmanlı Devleti'nde fıkıh siyaset ilişkisini fıkıh doktrini perspektifinden incelemektedir. Eser, Osmanlı'da örfî hukukun belirleyici, şer'î hukukun ise örfe tabi olduğu yönündeki yaygın kabulü eleştirmekte ve örfî hukukun tazir kavramı ekseninde şer'î hukukun açık bıraktığı sahada işlev gördüğünü, pratikte doktrine aykırı görünen uygulamalara rastlansa dahi prensipte bu ikisi arasında zıtlık değil tamamlayıcılık ilişkisi bulunduğunu savunmaktadır. Söz konusu iddiayı desteklemek için Osmanlı öncesi hukuk-siyaset ilişkisine dair literatür, Osmanlı kanunnameleri ve Osmanlı döneminden seçilmiş eserler derinlikli bir tahlile tabi tutulmuştur.
Abstract
Asım Cüneyd Köksal's work, Fiqh and Politics in the Ottomans, Siyâset-i Şer'iyye examines the relationship between fiqh and politics in the Ottoman Empire from the perspective of fiqh doctrine. The work criticizes the widespread acceptance in the Ottoman Empire that customary law is determinative and shar'i law is subject to custom, and that customary law functions in the field left open in the axis of the concept of tazir, although there are practices that seem contrary to the doctrine in practice, there is no contradiction between these two. argues that there is a complementarity relationship. In order to support the claim in question, the literature on the pre-Ottoman law-politics relationship, Ottoman law books and selected works from the Ottoman period were subjected to an in-depth analysis.
