Abstract

Eser, yazarın Oxford
Üniversitesi’nde, önde gelen fıkıh tarihçilerinden Prof. Christopher Melchert
yönetiminde tamamladığı doktora tezi esas alınarak hazırlanmıştır. Çalışmanın
ana kaynağı Memlük dönemi Hanefî fıkıh âlimi İbn Kutluboğa’nın (ö. 879/1474), Kudûrî’nin
(ö. 428/1037) el- Muhtasar’ına yazdığı et-Tercîh ve’t-tashîh ale’l-Kudûrî1 adlı
şerhtir. Yazar, söz konusu şerhten yola çıkarak, Hanefî mezhebinin klasik
sonrası döneminde şerh geleneği içerisinde gelişen tercih-tashih sürecini
tahlil etmekte ve bu yolla mezhebin entelektüel tarihine dair tespitlerini
ortaya koymaktadır. Eser bir giriş ve dört bölümden oluşmaktadır. Giriş
bölümünde yazar; mezhep, mezhep hukuku sistemi, tercih, tashih gibi temel
kavramları izah etmekte ve bu kavramlara dair literatürde yapılmış çalışmaları
kısaca tanıtmaktadır. Kitabın üzerinde durduğu ana kavram olan tercih, mezhep
geleneğinde üretilmiş ve muhafaza edilmiş görüşlerden birinin, belirli
gerekçelerle diğerleri arasından seçilmesi ve ilgili dönem için “mezhebin
görüşü” haline getirilmesini; tashih ise yine mezhebin önceki
literatüründeki seçilmiş ve kural olarak benimsenmiş görüşlerin gözden
geçirilerek onaylanmasını yahut düzeltilmesini ifade eder (s. 8-9).
